MetroDew.com (“we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have adopted the policy below toward copyright infringement. We reserve the right to block access to or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our advertisers, affiliates, content providers, members or users and remove and discontinue service to repeat offenders.
1. Procedure for Reporting Copyright Infringement
If you believe that your copyright has been infringed upon by material available on MetroDew.com, please provide a notice containing the following information to our Designated Copyright Agent listed below.
Your notice of infringement must include:
- A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.
- Identification of the copyrighted work or works claimed to have been infringed.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., the URL of the page on our site).
- Contact information for the complaining party, including your name, address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Upon receipt of a proper and complete infringement notification, we will take the following steps:
- Remove or disable access to the infringing material.
- Notify the content provider, member, or user that we have removed or disabled access to the material.
- For repeat offenders, we will terminate the content provider’s access to the service.
2. Counter-Notice Procedure
If the content provider, member, or user believes that the material that was removed or to which access was disabled is not infringing, or the user believes it has the right to post and use such material from the copyright owner, the copyright owner’s agent, or pursuant to the law, the user must send a counter-notice containing the following information to our Designated Copyright Agent:
- A physical or electronic signature of the content provider, member, or user.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement that you have a good faith belief that the material was removed or disabled as a result of a mistake or a misidentification of the material.
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, or if your address is located outside the United States, for any judicial district in which MetroDew.com is located, and that you will accept service of process from the person who provided notification of the alleged infringement.
If a counter-notice is received by our Designated Copyright Agent, we may send a copy of the counter-notice to the original complaining party, informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at our discretion.
